Statutory Declarations

A statutory declaration is a legal document that is used to affirm a statement of fact. It is typically used in situations where proof of a fact is required, but an affidavit is not applicable. For example, it may be required in order to register a birth or death, or to prove identity and residence when applying for a passport or visa.


Statutory declarations are legally binding documents and can be used as evidence in court. They must be made in front of an authorized witness and usually require the signatory to swear or affirm that the facts contained within the declaration are true. You have to declare the fact and sign statutory declaration in front of a Notary Public.

Tips to Write a Good Statutory Declarations


1. A clear statement of identity, including full name, address and occupation.

2. A statement that the person making the statutory declaration is of full age and understands the meaning of the declaration.

3. A statement that the person is aware that the statement is true and that the person making the declaration believes it to be true.

4. A statement that the person making the declaration understands that it is an offence to make a false declaration and that the person is aware of the penalties for making a false declaration.

5. The signature of the person making the declaration and the date.

6. The signature of the person before whom the declaration is made and the date. The person before whom the declaration is made must be a person authorized to do so.

7. The signature of a witness and the date. The witness must be an adult and not a party to the transaction.
